The 10th Amendment to the US Constitution says that all the powers not given to the federal government by the Constitution are reserved for the states and the people. This amendment was included in the Bill of Rights because the original thirteen colonies believed that a strong central government could assume to much power. Over the last two hundred years, the federal government has taken more power for itself at the expense of the states. The process began immediately after the Revolution was over. The Federal Government began taking away state powers under the guise of the Interstate Commerce powers. The feds used this Constitutional Right to regulate every possible industry. The more the power of the Northeast grew, the more federal government took and the south suffered. This lead to the War for Southern Independence. After the War, the feds pushed through the 14th Amendment, the Equal Protection Clause. This amendment has been used to take more and more power away from the states. FDR used this clause and the Interstate Commerce powers to move this nation very close to socialism.
Some of the issues that the Federal government have interfered with are abortion and religion. Now I know abortion is a slippery issue, but I feel it needs to be addressed. A few years ago Nebraska passed a law to ban late term abortion, but this was struck down by a federal court. Thank god that the Supreme Court has now reversed this ruling and has allowed states to pass these laws, but how long before a more liberal Supreme Court overturns that. I don't believe that the federal courts have any right to review state laws. They usually use the 14th Amendment as a rationalization to interfere in state business. Another important area where the federal courts interfere is in religion. The federal government uses the excuse of "Separation of Church and State". (Which is a joke and DOES NOT EXIST) Consistently federal courts who have no right to interfere rule on state laws and regulations. Frequently individuals sue in federal court over state matters such as religion in school and in public places. Look at prayer in school, taken out because of liberal federal courts. You can't have Christmas in the public squares, but you can have Islamic and secular symbols. This nation is 75% Christian, how come we have to bow to the other 25%. I realize that in New England and California this may not be a big deal, but in the south we take it seriously. Think how much better this nation would be with prayer and the Ten Commandments back in school. Would we have lost a generation to hip-hop and bad behavior and bad manners that we see in today's children. Look what happened when Roy Moore was forced by a federal court to remove the Ten Commandments from the Alabama state Supreme Court. He was very popular in Alabama and so was the monument. One person sued in a federal court after the Alabama courts wouldn't hear the case. Of course the coward Governor of Alabama caved into federal pressure as they mostly do. However, who can blame them, the federal government just threatens to close the bag of the "Magical Money Fairy" (The Federal Treasury) and states are forced to the federal's bidding. I wish just one governor would stand up and say No, I will not bow to the federal blackmail, not my state, we will stand up for our rights as a state as laid out in the Constitution. Unfortunately my governor in West Virginia is a spineless liberal and no one in this state will stand up and run against him. This is beside the point. I worry as the Supreme Court gets ready to rule on Gun Rights, how more could the federal courts stomp on Constitutional and State's rights.
I believe that a new Revolution is coming in this nation. The nation is slowly dissolving and we all know it. We are like the Romans watching their empire crumble and fall. Too many differences divide our people and I wonder if it is time for two nations, one north, one south, one liberal, one conservative, one secular, one Christian. Maybe it is time for this.
